Cancellation and Return Conditions

CONSUMER RIGHTS – CANCELLATION – RETURN CONDITIONS

GENERAL:
1. When you place an electronic order through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.
2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) regarding the sale and delivery of the product they purchase, as well as other applicable laws.
3. Shipping costs, which are the product shipment expenses, will be paid by the buyers.
4. Each product purchased is delivered to the person and/or institution at the address indicated by the buyer, not exceeding the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.
5. The purchased product must be delivered completely and in accordance with the specifications stated in the order, along with any certificates, manuals, etc., if available.
6. In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days from the moment they learn of it. The total amount must be returned to the Buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:
1. If the Buyer does not pay for the product they have purchased or cancels the transaction in the bank records, the Seller's obligation to deliver the product ceases.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:
1. After the product is delivered, if it is determined that the credit card used for payment by the buyer was unlawfully used by unauthorized persons, and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product subject to the contract to the SELLER within 3 days, with the shipping cost to be borne by the SELLER.

IF PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:
1. If unforeseeable force majeure events occur and the product cannot be delivered on time, the situation is communicated to the Buyer. The Buyer may request the cancellation of the order, its replacement with a similar product, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order and has made the payment in cash, the refund is made in cash within 14 days from the cancellation. If the payment was made by credit card and the Buyer cancels, the product price is returned to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the Buyer's account.

OBLIGATION OF BUYER TO INSPECT THE PRODUCT:
1. The Buyer will inspect the goods/services subject to the contract before taking them from the shipping company and will not accept goods/services which are crushed, broken, have torn packages, etc., and defective. Accepted goods/services are considered undamaged and intact. The BUYER must carefully preserve the goods/services after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The Invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:
1. The BUYER can exercise the right to withdraw from the contract within 14 (fourteen) days from the delivery date of the product they bought to them or to a person/institution at the address they indicated, by notifying the SELLER through the contact information below, without assuming any legal or penal liability and without giving any reason.

DURATION OF THE RIGHT OF WITHDRAWAL:
1. If the purchased item is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the delivery of the service has commenced with the consumer's approval before this period expires.
2. The expenses arising from the exercise of the right of withdrawal belong to the SELLER.
3. For the exercise of the right of withdrawal, written notification via registered mail, fax, or email must be sent to the SELLER within the 14 (fourteen) day period, and the product must be unused as stipulated in this contract's provisions on "Products for Which the Right of Withdrawal Cannot Be Used."

EXERCISE OF THE RIGHT OF WITHDRAWAL: 
1. The invoice of the product delivered to a 3rd party or the BUYER must be returned, (If the invoice of the product to be returned has been issued to a company, it must be sent back with the return invoice issued by the company. Order returns whose invoices are issued on behalf of the company cannot be completed without issuing a RETURN INVOICE.)
2. The return form, the box, packaging, and any standard accessories must be delivered completely and without damage.

RETURN CONDITIONS:
1. Upon receipt of the withdrawal notification, the SELLER is obliged to return the total amount and the documents that put the BUYER under debt to the BUYER within 10 days at the latest and to retake the item back within a 20-day period.
2. If the value of the good decreases due to the fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages at the rate of their fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the goods or product within the period of the right of withdrawal.
3. If the limit of the campaign organized by the SELLER is reduced due to the exercise of the right of withdrawal, the discount amount benefited from the campaign is canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:
1. Customized products prepared according to the BUYER's request or explicitly personal needs and not suitable for return, personal undergarments, swimwear bottoms, bikinis, makeup products, single-use products, goods at risk of perishing quickly or are likely to expire, products not suitable for health and hygiene reasons if their packaging is opened by the BUYER after delivery, products that are, by nature, mixed with other products and cannot be separated, subscriptions to newspapers and magazines except those provided under subscription agreements, services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer, or sound or image recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if their packaging is opened by the BUYER is not returnable under the regulation. Additionally, the right of withdrawal cannot be exercised for services commenced with consumer approval before the right of withdrawal period expires according to the regulation.
2. For cosmetic and personal care products, personal undergarments, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, and stationery supplies such as toner, cartridges, ribbons, etc., their packaging must be unopened, untested, undamaged, and unused for their return.

DEFAULT CONDITION AND LEGAL CONSEQUENCES
1. If the BUYER goes into default on transactions made with a credit card, the BUYER agrees, declares, and undertakes to pay interest under the credit card agreement made with the cardholder bank and to be responsible towards the bank. In this case, the relevant bank may resort to legal means; request the BUYER to cover the expenses and attorney's fees, and in the event of BUYER's default due to the debt, the BUYER agrees to compensate the SELLER's loss and damages due to late performance.
